1. TERMS OF SERVICE

This Terms of Service ("TOS") governs your use of the Small Engine Repair USA marketplace website and services ("Platform") operated by Small Engine Repair USA ("Company," "we," "us"). By accessing or using the Platform, you agree to these terms. If you use the Platform on behalf of an entity, you represent that you have authority to bind that entity.


1. Definitions

  • Customer: Individual or entity that requests services ("Jobs").
  • Technician or Tech: Independent service provider performing Jobs.
  • Services: Repair, maintenance, or other work ordered via the Platform.
  • User: Customer or Tech.

2. Eligibility & Registration

  • Users must be at least 18 years old and able to enter binding contracts.
  • Customers and Techs must register for an account, provide accurate information, and keep credentials secure.
  • Techs must submit a W-9, proof of insurance, and any required background-check consent before activation.

3. Platform Access

  • We grant a limited, non-exclusive, revocable license to access and use the Platform for its intended purpose.
  • You may not reverse-engineer, modify, or interfere with Platform operations.

4. Prohibited Conduct

Users shall not:

  • Violate laws or third-party rights;
  • Harass, abuse, or defraud any person;
  • Impersonate others or misrepresent affiliation;
  • Post illegal or harmful content;
  • Interfere with others' use of the Platform.

7. User Content & Licenses

  • Users retain ownership of content they post (photos, descriptions).
  • By posting, you grant Company a worldwide, royalty-free license to use, display, and distribute that content to operate and promote the Platform.

8. Intellectual Property

  • All Platform materials (software, trademarks, logos) are Company property.
  • You may not use Company IP without prior written consent.

9. Warranties & Disclaimers

  • The Platform and Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • Company disclaims all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of Liability

  • To the maximum extent permitted by law, Company's total liability shall not exceed the fees paid or received by Company for the specific Job in question.
  • In no event shall Company be liable for indirect, consequential, or punitive damages.

11. Indemnification

Users agree to indemnify and hold harmless Company, its officers, and affiliates from any claims arising out of your breach of this TOS or your negligence.

12. Governing Law & Dispute Resolution

  • This TOS is governed by the laws of the State of [State].
  • Any dispute shall be resolved by binding arbitration in [County], under the rules of the American Arbitration Association.
  • Small claims exceptions apply if your claim qualifies.
